In these Terms and Conditions, the following definitions apply unless the context otherwise requires:

• "php38" or "the Platform" refers to the online casino and sports betting platform operated at php38.vip, licensed and regulated by PAGCOR.
• "Player", "User", or "you" refers to any natural person who has registered an account on the php38 platform and uses any part of the services offered.
• "Account" refers to the registered user account created by a Player on php38, through which all gaming activity, financial transactions, and account management functions are conducted.
• "Services" refers to all games, betting markets, live dealer products, payment services, promotional offers, and any other features made available through the php38 platform.
• "Bonus" refers to any promotional credit, free spins, or other non-cash benefit made available to a Player by php38, subject to applicable wagering requirements and expiry dates.
• "Real Balance" refers to funds deposited by the Player from their own verified payment method, as distinct from bonus funds.
• "Bonus Balance" refers to funds credited to a Player's account through a promotional offer, which are subject to wagering requirements before conversion to withdrawable funds.
• "PAGCOR" refers to the Philippine Amusement and Gaming Corporation, the regulatory authority under whose license php38 operates.
• "KYC" refers to Know Your Customer identity verification procedures required by PAGCOR and Philippine anti-money laundering regulations.
• "GCash" and "Maya" refer to Philippine e-wallet payment services accepted on the php38 platform.

By registering an account on php38, clicking "I Agree" during the registration process, depositing funds, or accessing any part of the php38 Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety, together with the php38 Privacy Policy, Responsible Gaming Policy, and any applicable game-specific rules and promotional terms.

These Terms and Conditions constitute a legally binding agreement between you and php38. The agreement is governed by the laws of the Republic of the Philippines. By accepting these Terms, you submit to the exclusive jurisdiction of Philippine courts and PAGCOR's dispute resolution procedures for any matter arising from your use of the php38 platform.

php38 reserves the right to update, amend, or replace these Terms and Conditions at any time. Updated Terms take effect upon publication on this page. Players are responsible for reviewing the current Terms before each session. Material changes will be communicated via account notification or email where practicable.

In addition to the age requirement, the following eligibility conditions apply to all php38 accounts:

• You must be a natural person, not a corporation, partnership, or other legal entity.
• You must be physically located in a jurisdiction where online casino gaming is permitted. php38 is licensed by PAGCOR and is primarily available to players in the Philippines. Access from jurisdictions where online gambling is prohibited is not permitted.
• You must not currently be subject to a self-exclusion order, voluntary exclusion agreement, or PAGCOR-mandated exclusion that covers the php38 platform.
• You must not be an employee, contractor, or immediate family member of an employee or contractor of php38, its parent companies, affiliates, or technology providers.
• You must not be a politically exposed person (PEP) or otherwise disqualified under Philippine Anti-Money Laundering Act (AMLA) provisions without completing enhanced due diligence procedures.
• You must have the legal capacity to enter into a binding agreement under Philippine law.

php38 reserves the right to verify eligibility at any time and to refuse or terminate service to any Player who does not meet these requirements, with or without prior notice.

To access real-money gaming services on php38, you must create a single registered account. The following conditions apply to account registration:

• Each Player is permitted to hold only one (1) active account on php38 at any time. Creation of multiple accounts by the same individual — regardless of whether different email addresses, mobile numbers, or payment methods are used — constitutes a material breach of these Terms and will result in the immediate suspension of all associated accounts and forfeiture of all balances.
• All information provided during registration — including your name, date of birth, Philippine mobile number, and identity document details — must be accurate, complete, and current. Providing false or misleading registration information is grounds for immediate account termination.
• You must complete KYC identity verification before making any real-money deposit or withdrawal. Accepted identity documents include: UMID, PhilSys National ID, Philippine Driver's License, or Philippine Passport.
• php38 may request additional documentation at any time for enhanced due diligence, including but not limited to proof of address, source of funds verification, or tax identification confirmation.
• Account registration is free and there is no fee charged by php38 for KYC document submission or review.

You are solely responsible for the security and confidentiality of your php38 account login credentials, including your username, password, and any two-factor authentication codes. php38 strongly recommends:

• Using a strong, unique password that you do not use for any other website or service.
• Enabling two-factor authentication (2FA) via SMS to your registered Philippine mobile number.
• Logging out fully from any shared or public device after each session.
• Never sharing your login credentials, OTP codes, or account details with any other person, including individuals claiming to be php38 support staff.

php38 customer support staff will never ask for your full password via any communication channel. Any communication purporting to be from php38 that requests your full password should be treated as fraudulent and reported to php38 support immediately.

php38 is not responsible for any loss of funds resulting from unauthorized account access where the Player has failed to maintain adequate security of their credentials, or where the Player has voluntarily shared credentials with a third party.

Where php38 has reasonable grounds to suspect that an account has been accessed by an unauthorized third party, or that account security has been compromised, php38 reserves the right to suspend the account immediately and require re-verification before restoring access.

All php38 account balances are denominated exclusively in Philippine Peso (₱). The following terms govern all financial transactions on the php38 platform:

Deposits:

• The minimum deposit amount is ₱100 per transaction.
• Accepted deposit methods include GCash, Maya, GrabPay, BPI, BDO, Metrobank, InstaPay, PesoNet, and 7-Eleven CLiQQ.
• GCash and Maya deposits are credited to your php38 account instantly upon confirmation.
• Bank transfers via InstaPay and PesoNet are subject to standard interbank processing times and may take up to 30 minutes during business hours.
• php38 does not charge fees on deposits. However, your payment provider may apply their own fees, which are the Player's sole responsibility.

Withdrawals:

• Withdrawal requests are processed within 1–2 hours for GCash and Maya, subject to completed KYC verification and the absence of any pending bonus wagering requirements on the withdrawal amount.
• The minimum withdrawal amount is ₱200 per transaction.
• Withdrawals may only be made to the same payment method used for the Player's most recent verified deposit, in compliance with PAGCOR anti-money laundering requirements.
• php38 reserves the right to perform additional identity verification before processing any withdrawal, particularly for large withdrawals or where unusual account activity has been detected.
• Withdrawals of bonus funds are not permitted until all applicable wagering requirements have been fully satisfied.

php38 offers a range of promotional bonuses to registered players. The following general terms apply to all php38 bonuses and promotions:

• All bonuses are subject to specific wagering requirements, which must be satisfied before any bonus funds or winnings derived from bonus funds can be withdrawn. Wagering requirements are stated clearly in each individual promotion's terms.
• Unless stated otherwise in the specific promotion terms, the standard wagering requirement for php38 deposit bonuses is 30× the bonus amount.
• Bonuses have an expiry period, after which any unmet wagering requirements and associated bonus balance will be forfeited. Expiry periods are stated in each individual promotion.
• php38 reserves the right to withdraw, modify, or cancel any promotional offer at any time without prior notice. Changes to active bonuses already credited to a Player's account will not result in retroactive changes to applicable wagering requirements unless required by PAGCOR regulation.
• Bonuses may not be transferred between accounts or converted to cash outside of normal wagering completion.
• Misuse of bonuses — including, but not limited to, opening multiple accounts to claim multiple welcome bonuses, or systematic exploitation of bonus structures through low-variance betting patterns designed to meet wagering requirements with minimal risk — is prohibited and will result in account suspension and forfeiture of all bonus balances.
• php38 reserves the right to withhold or void winnings derived from bonuses where there is reasonable evidence of promotional abuse.

All games available on the php38 platform are governed by their individual game rules, which are accessible within each game interface. In addition, the following general terms apply:

• All electronic casino games (slots, RNG table games, video poker) on php38 are operated using PAGCOR-certified random number generation (RNG) systems. The RNG certification ensures game outcomes are statistically random and not influenced by prior results, player identity, or bet size.
• Published Return to Player (RTP) percentages represent the theoretical long-run average return across all play on that game configuration and do not guarantee individual session results.
• Live dealer games are conducted by trained human dealers in licensed studio environments and are subject to both php38's internal standards and applicable PAGCOR live gaming regulations.
• In the event of a verified technical malfunction during a game round — including server disconnection, software error, or power failure — the affected game round will be voided and any stake placed will be refunded to the Player's account. php38's decision on the appropriate remedy for technical malfunctions is final.
• php38 is not responsible for Player losses resulting from the Player's own technical issues, including internet disconnection, device malfunction, or browser incompatibility, where the game server has recorded a valid completed round.
• Minimum and maximum bet limits apply to all games and betting markets. These limits are set within each game interface and may be modified by php38 at any time.

The following activities are strictly prohibited on the php38 platform. Engaging in any prohibited activity will result in immediate account suspension, forfeiture of all balances, and may be reported to PAGCOR and/or Philippine law enforcement authorities:

• Creating, operating, or benefitting from multiple accounts (multi-accounting).
• Using automated software, bots, scripts, or any artificial intelligence tool to place bets, claim bonuses, or interact with the php38 platform in a manner not available to standard human players.
• Colluding with other Players to gain an unfair advantage in any game, including live poker, live dealer tables, or any skill-based game offered on php38.
• Money laundering, structuring of deposits to avoid AML reporting thresholds, or any other financial crime involving the php38 platform.
• Reverse engineering, hacking, or attempting to exploit any vulnerability in the php38 platform's software, RNG, or security systems.
• Using the php38 platform in connection with any fraudulent activity, including use of stolen payment credentials or false identity documents.
• Accessing php38 from a jurisdiction where online gambling is prohibited under local law, using VPN or proxy services to circumvent geographic restrictions.
• Engaging in or facilitating any form of match-fixing, sports manipulation, or insider betting in connection with php38's sports betting markets.
• Harassing, threatening, or engaging in abusive behavior toward php38 staff, live dealers, or other players.

php38 is committed to providing a safe, responsible gambling environment in compliance with PAGCOR's Responsible Gaming standards. The following tools are available to all registered Players through their account settings:

• Deposit Limits: Daily, weekly, and monthly deposit limits can be set at any amount above the minimum deposit. Reductions take effect immediately; increases are subject to a 24-hour cooling-off period.
• Loss Limits: Daily, weekly, and monthly loss limits can be configured independently from deposit limits.
• Session Time Limits: Maximum session duration limits can be set, with optional automatic logout upon limit expiry.
• Reality Checks: Pop-up notifications at configurable intervals (every 15, 30, or 60 minutes) displaying net session win/loss information.
• Cooling-Off Period: Temporary account suspension for 24 hours, 72 hours, or 7 days, during which no deposits or bets can be placed.

All content, software, trademarks, trade names, logos, graphics, game interfaces, and other intellectual property available on the php38 platform are the exclusive property of php38 and its licensors, and are protected under applicable Philippine and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the php38 platform solely for your personal, non-commercial gaming purposes, in accordance with these Terms and Conditions. This license does not permit you to:

• Copy, reproduce, distribute, or create derivative works from any php38 content without express prior written consent from php38.
• Use the php38 name, logo, or brand elements in any commercial context without express prior written consent.
• Scrape, crawl, or systematically extract data from the php38 platform using automated tools.
• Frame, mirror, or republish any php38 content on any third-party website or platform.

Any unauthorized use of php38 intellectual property may result in legal action under Philippine intellectual property law.

To the maximum extent permitted by applicable Philippine law, php38's total liability to you for any claim arising from your use of the platform — whether in contract, tort, negligence, or otherwise — shall not exceed the total amount of real funds deposited by you into your php38 account in the thirty (30) days immediately preceding the date the claim arises.

php38 shall not be liable for:

• Any indirect, consequential, special, incidental, or punitive damages arising from your use of the php38 platform.
• Loss of profits, loss of opportunity, or any other economic loss arising from gaming outcomes.
• Service interruptions, delays, or errors attributable to factors outside php38's reasonable control, including but not limited to internet service provider outages, third-party payment system failures, force majeure events, or PAGCOR-ordered platform suspensions.
• Any loss arising from your failure to maintain the security of your account credentials.
• Any tax liability you may incur in connection with winnings received from php38, as tax obligations for gambling winnings are the sole responsibility of the Player under Philippine law.

Nothing in these Terms excludes php38's liability for death or personal injury caused by php38's gross negligence, or any liability that cannot be excluded or limited by applicable Philippine law.

php38 reserves the right to suspend, restrict, or permanently terminate any Player account, with or without prior notice, in any of the following circumstances:

• Breach of any provision of these Terms and Conditions, including the Prohibited Activities outlined in Section 9.
• Failure to complete KYC verification within the required timeframe.
• Provision of false or misleading registration or verification information.
• Suspected money laundering, fraud, or any other financial crime in connection with the account.
• Detection of multi-accounting or systematic bonus abuse.
• Account inactivity for a period exceeding twelve (12) consecutive months.
• PAGCOR directive or court order requiring account closure.

In the event of account termination for breach of these Terms, php38 reserves the right to retain any funds held in the account as a consequence of the breach, subject to PAGCOR oversight. Where termination is not the result of Player breach, php38 will process the withdrawal of any verified Real Balance to the Player's verified payment method within a reasonable timeframe.

Players wishing to voluntarily close their account may request closure via php38's 24/7 live chat support. Voluntary account closure is processed within 48 hours of verified request, with any outstanding Real Balance returned to the verified payment method on file.

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles.

In the event of a dispute between you and php38 arising from these Terms or your use of the platform, the following resolution process applies:

1. Direct Resolution: You should first contact php38's 24/7 customer support team via live chat with full details of the dispute. php38 aims to resolve all support queries within 24 hours.
2. Formal Complaint: If the dispute is not resolved through support contact, you may submit a formal written complaint to [email protected]. php38 will acknowledge formal complaints within 48 hours and provide a substantive response within 10 business days.
3. PAGCOR Escalation: If you remain unsatisfied with php38's resolution, you may escalate the matter to PAGCOR through their official complaints procedure. As a PAGCOR-licensed operator, php38 is subject to PAGCOR oversight and dispute resolution authority.
4. Philippine Courts: For matters not resolved through the above process, the courts of the Republic of the Philippines have exclusive jurisdiction. You consent to the personal jurisdiction of Philippine courts in connection with any legal proceeding arising from these Terms.

php38 reserves the right to amend, update, or replace these Terms and Conditions at any time. The effective date of the current version is displayed at the top of this page. The most current version of the Terms will always be available at php38.vip/terms-conditions.

For material changes — those that significantly affect Players' rights or obligations — php38 will provide advance notice via account notification, in-platform messaging, or email to the registered address on file, where practicable. The minimum advance notice period for material changes is five (5) business days, unless the change is required by PAGCOR directive or Philippine law, in which case it takes effect immediately.

Continued use of the php38 platform following the posting of updated Terms constitutes your acceptance of those Terms. If you do not agree with any changes to the Terms, you must stop using the platform and close your account before the updated Terms take effect.
